2021, a new year: do you think about the indexation of alimony!

Every year on 1 January alimony must be indexed. Read more about how to do this.

Alimony up by 3%

The indexation figures as per 1 January 2021 for partner and child maintenance became known in November. See also our earlier report on this subject. By law, all alimony payments will be indexed/uprated by 3% as per 1 January 2021. This is only different when different agreements have been made.

As the person liable to pay alimony, you should think about indexation yourself!
As the person entitled to maintenance, you can point this out to the person owing the maintenance.

Sample text for the letter to your ex-partner

A sample text to remind your ex-partner of the indexation is below.

As you know, alimony is indexed every year. Last year you paid € ....... a month in child support and € ....... per month in spousal support.

If the indexation has not been paid for years, it is possible to claim the 'forgotten' indexation up to five years back. In that case, you make a calculation of the arrears at www.lbio.nl/indexering and add the calculation to your letter. Include the following text in your letter:

I hereby also claim the indexation of the past five years. The total amounts to € ................
I request that you pay this amount to me within one week of today's date on account number ..............

Your ex-partner does not cooperate

If your ex-partner is not willing to cooperate in the increase, you can call in the bailiff or the LBIO. The alimony must be laid down in an order (= a court ruling).

Alteration of maintenance, e.g. by Corona
